No. 7484) sets the legal principles for introducing a compulsory marking of oil products; determines mutual rights, duties and obligations of the oil products distributers, and the authorized state supervisory bodies in this sector.  

 

The Law is recommended for adoption in view of the lack of developed and harmonized laws on the turnover and quality of oil products in Ukraine, which impedes attraction of investments into the oil processing industry and decreases the competitive ability of the Ukrainian economy. The lack of efficient governmental tools of control over the oil products market provokes the rise of the criminal groups that illegally produce and import excisable oil products to evade taxes.    

 

The author of the bill referred to the international experience in resolving a similar problem in the developed European states. The EU countries adopted Council Directive 95/60/EEC on the fiscal marking of gas oil and kerosene in 1996 to prevent the sale of adulterated oil products. The Direction introduces a compulsory marking of oil products with a chemical substance, ‘Euromarker´, that is added prior to the release of the oil products under the supervision of the fiscal bodies.

 

Alongside the fiscal markers, the EU member states can add a special national marker or a colour identifying the country of origin into the oil products.  

 

The speaker stressed that not only EU member states, but also 72 other countries introduced the tool of marking the oil products.

 

The Committee members regard the legislative proposal as valid and topical. Its implementation will strengthen control over the turnover of oil products, and increase the State Budget revenue.
